Agreement to terms
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and KicksOnFire (“we,” “us,” or “our”), concerning your access to and use of the kicksonfire.comwebsite as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).
You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms of Use, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Use to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.
The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
Strict age requirement: The Site, mobile applications, and all associated marketplace or promotional features are intended exclusively for users who are at least 18 years old. Persons under the age of 18 are strictly prohibited from using the Site, creating accounts, subscribing to alerts, purchasing virtual items, or participating in any marketplace or giveaway offerings.
Intellectual property rights
Our proprietary content
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, foreign jurisdictions, and international conventions. The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.
Third-party trademark & brand non-affiliation
All third-party product names, logos, brands, trademarks, and registered trademarks (e.g., Nike, Jordan, Adidas, Yeezy, etc.) featured or referred to within the Site are the property of their respective trademark holders. Unless expressly stated otherwise, KicksOnFire is not affiliated, associated, authorized, endorsed by, or in any way officially connected with these trademark owners or any of their subsidiaries or affiliates. The use of these names and brands is solely for identification, descriptive, and product discovery purposes.
User-generated content (UGC)
The Site and mobile applications allow you to upload, submit, post, display, or transmit content, including but not limited to user profile avatars, Local Heat marketplace listing photos, descriptions, and text messages sent via our in-app chat systems (collectively, “User-Generated Content” or “UGC”).
Your responsibility for UGC: You are solely responsible for the UGC you post. You represent and warrant that you own or have the necessary licenses and rights to distribute your UGC and that it does not infringe upon the intellectual property, privacy, or publicity rights of any third party.
License grant to KicksOnFire: By uploading or posting UGC to the Site or mobile applications, you grant KicksOnFire a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, display, modify, distribute, and archive your UGC (such as listing photos and descriptions) for platform operation, promotional purposes, and marketplace optimization across any media channels.
Right to monitor and remove: We reserve the absolute right, but assume no legal obligation, to pre-screen, review, flag, filter, modify, or delete any UGC at any time and for any reason without prior notice, including UGC that we deem to violate these Terms of Use or mobile application store guidelines.
Digital Millennium Copyright Act (DMCA) notice and takedown
We respect the intellectual property rights of others. If you believe that any material available on or through the Site infringes upon any copyright you own or control, please immediately notify our Designated Copyright Agent using the contact information provided below (a “Notification”).
To be effective, the Notification must be a written communication that includes the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the infringed right;
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material;
- Your contact information, including your address, telephone number, and an email address;
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner; and
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.

Editorial & market intelligence disclaimers
KicksOnFire is primarily an information, data aggregation, and product discovery platform. The Site features editorial content, sneaker release dates, estimated retail prices, colorway specifications, production details, countdown timers (“Days until retail”), popularity rankings, and various algorithmic platform metrics (such as “Heat Scores” and aggregated “Want” counts).
Informational purposes only: All market intelligence, price estimations, and data indexes are provided for informational and entertainment purposes only. Nothing on the Site constitutes financial, investment, commercial, or purchasing advice.
Data errors and delays: Sneaker release environments are highly volatile. You explicitly acknowledge that release dates, retail pricing data, stock availability projections, and product specifications may be delayed, incomplete, estimated, or entirely inaccurate. KicksOnFire is not liable for any financial losses, missed purchase opportunities, or decisions made based on stale or inaccurate data on the Site.
Algorithmic metrics:“Heat Scores,” “Want” tallies, and shop sorting configurations are proprietary algorithmic signals calculated from internal user activity and platform engagement. They are not metrics of financial value, guarantees of secondary market performance, or assurances of real-world retail availability.
“Want” alert subscriptions
The Site provides a “Want” feature that functions as an interactive alert subscription. When you select a specific shoe size and click “Want,” you are registering a preference linked to a reference price captured at the time of subscription.
Alert delivery: Based on your settings, the platform will attempt to dispatch push notifications or email alerts when internal systems log a drop in market pricing or a return of size availability.
No guarantee of delivery or availability: We do not guarantee that alerts will be sent or received instantaneously. System processing latencies, network carrier connectivity, and email filtering may delay or prevent delivery. Furthermore, an alert notification does not guarantee that the product remains in stock or available at the notified price by the time you navigate to the offer.
Virtual items and in-app points
The mobile application may include a virtual points system utilizing digital tokens (“Points”). Points can be earned through specified in-app engagement or purchased via third-party mobile storefront app stores (Apple App Store / Google Play Store).
Non-monetary status: Points constitute a limited, personal, revocable, non-transferable, and non-sublicensable license to access specific promotional features of the Site (such as the #FreeKicks sweepstakes entry system). Points do not constitute real currency, property, or a store credit balance. Points have zero real-world monetary value, cannot be redeemed for fiat currency, and cannot be transferred or sold to other users.
No refunds on virtual purchases: All purchases of Points are final and entirely non-refundable. KicksOnFire reserves the absolute right to manage, regulate, modify, or eliminate virtual Points at any time in its sole discretion without liability or financial recourse to you.
User representations
By using the Site, you represent and warrant that:
- All registration information you submit will be true, accurate, current, and complete;
- You will maintain the accuracy of such information and promptly update such registration information as necessary;
- You have the legal capacity and you agree to comply with these Terms of Use;
- You are not under the age of 18;
- You will not access the Site through automated or non-human means, whether through a bot, script, or otherwise;
- You will not use the Site for any illegal or unauthorized purpose; and
- Your use of the Site will not violate any applicable law or regulation.
If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).
User registration
You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
Buy Now purchases, payments, & authenticity
Enterprise partner fulfillment
The Site features a “Buy Now” checkout system. KicksOnFire does not directly own, warehouse, possess, or ship inventory for Buy Now orders. All Buy Now transactions are routed to and fulfilled by our designated third-party enterprise partners.
Checkout & payment processors
All online checkout transactions on the Site are routed securely through PayPal or PayPal-managed processing flows. KicksOnFire does not directly store, process, or transmit payment card numbers on our own servers.
Bank statement billing descriptors
Because transactions are handled in conjunction with third-party logistics and retail entities, your credit card or bank account statements may display the specific merchant descriptor name of our processing enterprise partner rather than “KicksOnFire.”
Return policy: all sales final
For all completed Buy Now orders, ALL SALES ARE FINAL. No returns, refunds, cancellations, or item exchanges are permitted, subject to the following strict exception:
Defect / wrong-item disputes: If an item arrives substantially defective, damaged, or is the completely incorrect size/style relative to your order confirmation, you must initiate a formal dispute through our customer support channels within three (3) calendar days of the documented delivery date. Disputes raised after three days will not be eligible for review or reimbursement under any circumstances.
Product authenticity representations
Authenticity representations and deadstock guarantees apply strictly and exclusively to Buy Now transactions fulfilled by our authorized enterprise partners. KicksOnFire enforces rigorous compliance standards on these commercial partners. Conversely, Local Heat listings are strictly peer-to-peer (P2P) user transactions and are not authenticated, verified, or inspected by KicksOnFire.

Submissions
You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the Site (“Submissions”) provided by you to us are non-confidential and shall become our sole property. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.
Site management
We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these Terms of Use; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Use; (3) refuse, restrict access to, limit the availability of, or disable any of your UGC or marketplace listings; and (4) manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the marketplace features.

We care about data privacy and security. Please review our full Privacy Policy. By using the Site or mobile applications, you agree to be bound by our Privacy Policy, which is incorporated into these Terms of Use.
Strict enforcement of minor prohibition (COPPA policy)
The platform is strictly restricted to users aged 18 and older. We do not knowingly collect, request, or solicit information from children under the age of 13, nor do we market to minors. If we receive actual knowledge that an individual under the age of 13 has bypassed our registration gates and provided personal information, we will purge that data from our production systems as quickly as is reasonably practical.

User right to account deletion
You may terminate your account and your relationship with KicksOnFire at any time. These Terms of Use shall remain in full force and effect while you use the Site. Modifications and interruptions
We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. Governing law
These Terms of Use and your use of the Site are governed by and construed in accordance with the laws of the State of New Jersey applicable to agreements made and to be entirely performed within the State of New Jersey, without regard to its conflict of law principles.
Dispute resolution
Binding arbitration
If the Parties are unable to resolve a Dispute through informal negotiations, the Dispute will be finally and exclusively resolved by binding arbitration. YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL.
The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) and, where appropriate, the AAA’s Supplementary Procedures for Consumer Related Disputes (“AAA Consumer Rules”). The arbitration may be conducted in person, through document submission, by phone, or online. Except where otherwise required by AAA rules or applicable law, the arbitration will take place in Middlesex County, New Jersey.
Class action waiver
THE PARTIES AGREE THAT ANY ARBITRATION SHALL BE LIMITED TO THE DISPUTE BETWEEN THE PARTIES INDIVIDUALLY. TO THE FULLEST EXTENT PERMITTED BY LAW: (A) NO ARBITRATION SHALL BE JOINED WITH ANY OTHER PROCEEDING; (B) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE ARBITRATED ON A CLASS-ACTION BASIS OR TO UTILIZE CLASS ACTION PROCEDURES; AND (C) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE BROUGHT IN A PURPORTED REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR ANY OTHER PERSONS.
Court venue carve-out
To the extent that any Dispute is not permitted by applicable law to be settled via binding arbitration, or should any aspect of a dispute proceed to court, such legal action shall be commenced or prosecuted exclusively in the state and federal courts located in Middlesex County, New Jersey, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens. In no event shall any claim or action related to the Site be commenced more than one (1) year after the cause of action arose.
Limitations of liability
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims.
Addendum A: Local Heat marketplace
Live addendum · July 2026
1. KicksOnFire is a venue — not a party to your deal
Local Heat allows users who comply with our policies to offer, browse, and arrange local in-person transactions for sneakers and related items. KicksOnFire is not directly involved in the transaction between buyers and sellers. We do not take possession of items, process payments for the goods themselves, authenticate items, guarantee condition, or guarantee that a buyer or seller will complete a meetup.
As a result, KicksOnFire has no control over the quality, safety, legality, or authenticity of any item listed; the truth or accuracy of listings; the ability of sellers to sell or buyers to pay at a meetup; or user conduct offline. KicksOnFire does not transfer legal ownership of items between users. You use Local Heat entirely at your own risk.
2. Marketplace authentication carve-out
You explicitly acknowledge that Local Heat transactions are peer-to-peer (P2P) user listings and are NOT authenticated, inspected, or vetted by KicksOnFire. The authenticity warranties and deadstock vetting standard applied to KicksOnFire “Buy Now” platform products are handled entirely by enterprise logistics partners and do not extend, copy, or apply to any item listed within the Local Heat P2P local environment.
3. Eligibility — 18+ and verified sellers
Local Heat is available only to individuals who are 18 years of age or older and can form legally binding contracts. To publish a listing, sellers must complete phone verification, pay a one-time Verified Local Heat Seller fee (currently $0 USD), and pass identity verification through our third-party provider, Stripe Identity. We may refuse access or revoke verification status at our sole discretion.
4. Seller verification fee & Stripe disclaimer
The verification fee covers identity verification infrastructure costs and activation of the Verified Local Heat Seller status. The fee includes up to two (2) identity verification attempts within seven (7) days of payment. The fee is non-refundable once the identity verification session begins, except where required by law.
Verification disclaimer: Identity verification is processed via Stripe Identity. KicksOnFire does not guarantee the absolute accuracy of verification systems, nor does user verification guarantee the future safety, honesty, item authenticity, or legal conduct of any user.
5. Off-platform payment at meetups
Local Heat listings are intended solely for physical, in-person meetups. Payment for the transaction item (via cash, Venmo, Zelle, or other peer-to-peer methods arranged between users) is conducted exclusively between the buyer and the seller. KicksOnFire is not involved in meetup payments, does not hold or escrow funds for local transactions, and does not provide buyer or seller protection policies for off-platform payments.
5a. User tax responsibilities
You are solely responsible for determining, calculating, reporting, and remitting any and all applicable local, state, federal, or international taxes (including sales, use, value-added, or income taxes) that result from your P2P transactions via Local Heat. KicksOnFire does not track transaction totals for off-platform payments, does not issue tax documents (such as IRS Forms 1099-K) for local meetups, and assumes zero liability for your tax compliance.
6. In-person meetups & absolute assumption of risk
Users are solely responsible for interactions with others and must comply with applicable local laws. KicksOnFire does not supervise, schedule, or protect meetups, and is not responsible for user acts, omissions, or criminal actions at meetups.
YOU EXPLICITLY ASSUME ALL RISKS ASSOCIATED WITH IN-PERSON MEETUPS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE KICKSONFIRE, ITS AFFILIATES, OFFICERS, AND EMPLOYEES FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, PERSONAL INJURY, PROPERTY DAMAGE, OR LOSSES ARISING OUT OF OR IN ANY WAY CONNECTED WITH MEETUPS, TRANSACTION DISPUTES, OR THE ACTIONS OF THIRD PARTIES. Exercise extreme caution: utilize well-lit public places, inspect items carefully before issuing payment, and bring a companion where practical.
7. Listings, accuracy, and prohibited items
By creating a marketplace listing, you represent that you hold the legal right to sell the item and that your listing description, condition, size, price, and photographs are entirely accurate and reflect the actual product. Prohibited listing practices include, but are not limited to: counterfeit goods, stolen property, duplicate listings, placeholder text, and ban-evasion accounts.
8. Location data and neighborhood privacy
Local Heat listings use approximate location pickup areas (neighborhood-level mapping data) to help organize transactions rather than exact residential addresses. Please review our specific Privacy Policy — Local Heat sections to understand how your geographic location coordinates and identity data are securely managed.
9. Moderation and rights of account termination
We reserve the right, but not the obligation, to remove marketplace listings, suspend user profiles, or revoke Verified Status indefinitely for violations of these terms, platform manipulation, or any perceived security risk to the KicksOnFire community.
10. In-app messaging and user-generated content (UGC)
The mobile application provides a direct messaging feature to allow users to coordinate local marketplace meetups. All text, images, or media sent via in-app messaging constitute User-Generated Content (UGC).
Zero tolerance policy: KicksOnFire maintains a strict zero-tolerance policy for objectionable material, scam solicitations, harassment, hate speech, threats, or abusive user behavior.
Reporting and blocking mechanisms: The app provides built-in tools allowing users to report objectionable messaging items and instantly block abusive profiles.
Moderation window: KicksOnFire complies with mobile app store distribution regulations and will act upon reported UGC violations within 24 hours by removing the offending content and/or terminating or suspending the abusive account.
11. Disclaimer of chat liability & safety warning
KicksOnFire does not pre-screen, monitor, or endorse the text or media content of private in-app messages between users. You are solely responsible for your communications.
No liability for content: KicksOnFire is not liable for any defamatory, offensive, fraudulent, or illegal text sent by users through the messaging platform.
Off-platform communication & links: If a user requests that you move communications off-platform (e.g., to text message or external social applications) or transmits external payment links, you do so entirely at your own risk. KicksOnFire will never ask you to complete a Local Heat transaction or issue a payment outside of the official application environment.
12. Automated screening and moderation disclaimer
To foster a safe marketplace environment, KicksOnFire utilizes automated background text filters to detect and flag profanity, commercial spam, off-platform payment phrases, and potential fraudulent activity within the messaging system.
No guarantee of detection:You acknowledge and agree that these automated tools are provided “AS-IS” and may not catch all objectionable, fraudulent, or harmful phrases. The presence of background filters does not guarantee that the application is entirely free of scams or offensive material.
Limitation of liability for filters: KicksOnFire is not liable to you or any third party for any failure of automated systems to block or flag harmful content, nor are we liable for any losses, scams, or damages resulting from communications that bypass our automated triggers.
False positives:We reserve the right, in our sole discretion, to automatically block, delay, or redact messages that trigger our filters. KicksOnFire is not liable for any disruption to legitimate communications caused by automated filtering errors (“false positives”).
13. Peer-to-peer ratings and reviews
The mobile application permits users to rate and write reviews for one another following the completion (or attempted completion) of a local transaction.
User feedback responsibilities:All reviews must be honest, accurate, and reflect a firsthand transaction or meetup experience. You are prohibited from: (a) posting fake, fabricated, or AI-generated reviews; (b) compensating or offering incentives to others to post specific positive or negative ratings; (c) using reviews to threaten, harass, or extort other users; or (d) creating multiple accounts to artificially manipulate any user’s rating profile.
Limitation of liability for reviews: You acknowledge that ratings and reviews are the sole opinions of the users who write them. KicksOnFire does not verify the truth or accuracy of user reviews. To the fullest extent permitted by law, KicksOnFire disclaims all liability for defamation, libel, emotional distress, or financial loss resulting from any user-submitted review or rating.
Right to remove feedback content: While KicksOnFire complies with consumer protection laws regarding honest feedback, we reserve the absolute right, in our sole discretion and without prior notice, to remove or redact reviews that contain profanity, hate speech, personally identifiable information (doxxing), or clear evidence of bad-faith manipulation.
14. Transaction confirmation mechanism
To unlock the ability to issue a public rating and review, both the buyer and the seller must mutually confirm via the app interface that an in-person meetup was initiated or completed.
KicksOnFire does not independently verify whether a meetup occurred, whether a transaction was finalized, or the accuracy of a user’s confirmation status. You agree that KicksOnFire is not responsible or liable for any user’s failure, refusal, or delay in tapping the confirmation button, even if such refusal prevents you from leaving a review. KicksOnFire will not act as an arbiter or judge in disputes where one party claims a meetup happened and the other denies it.
15. Reporting failed transactions and safety incidents
If an in-person meetup is cancelled, fails to occur, or results in an immediate dispute (such as a user failing to show up, attempting to sell counterfeit goods, or engaging in suspicious behavior), users should not rely on the public review system. Instead, you must report the incident directly to KicksOnFire using the in-app reporting feature.
Investigation discretion:KicksOnFire reviews all submitted reports. However, we reserve the absolute right, in our sole discretion, to determine what action to take, if any, including issuing warnings, revoking “Verified Seller” status, or permanently banning the reported account.
No obligation to disclose outcomes: To protect privacy and system integrity, KicksOnFire is under no obligation to share the results of an internal investigation or the disciplinary actions taken against a reported user with the reporting party.
Emergency situations: The in-app report feature is for platform moderation purposes only. If an in-person meetup results in an immediate threat to physical safety, criminal activity, or theft, users must contact local law enforcement authorities immediately before notifying KicksOnFire.
Addendum B: #FreeKicks giveaway official rules framework
Live framework · September 2026
Free entry without coins: https://www.kicksonfire.com/sweepstakes/entry
The following provisions establish the general master rules for giveaways, sweepstakes, and contests hosted by KicksOnFire within the mobile application (collectively, the “#FreeKicks Promotions”). Individual giveaways listed inside the app may introduce specific variation parameters (such as entry timelines or specific product prize descriptions), which supplement these Master Rules.
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR EXCHANGE OF PURCHASED DIGITAL POINTS DOES NOT IMPROVE YOUR CHANCES OF WINNING. ODDS OF WINNING DEPEND ENTIRELY ON THE TOTAL NUMBER OF ELIGIBLE ENTRIES RECEIVED. VOID WHERE PROHIBITED BY LAW.
1. Master promotion eligibility
Promotions are open only to natural persons who are legal residents and physically located in one (1) of the fifty (50) United States or the District of Columbia and who are eighteen (18) years of age or older at the exact time of transaction entry. Entries originating from any outside jurisdiction are automatically disqualified.
Employees of KicksOnFire.com LLC (“Sponsor”), its corresponding corporate parent entities, affiliates, logistics subsidiaries, advertising agencies, and the immediate family members or co-residents of such employees are strictly ineligible to participate or claim rewards.
2. Dual-entry pathways (app vs. free online entry)
Eligible participants may gain entry via two alternative methods:
(i) In-app entry mechanism:Navigate to the #FreeKicks interface tab on the mobile application, select the designated featured giveaway, and complete your entry by pressing “Enter.” This operational path consumes digital platform Points (earned organically via activities or purchased as software licenses within the platform ecosystem, if and when point purchases are offered).
(ii) Free online entry: To enter without using or buying digital points, open https://www.kicksonfire.com/sweepstakes/entry and submit your full legal name, complete mailing address, the email address on your KicksOnFire account, telephone number, the giveaway, and your date of birth before that giveaway ends.
There is a strict limit of one (1) entry per natural person per individual giveaway promotion, regardless of the tracking methodology deployed.
3. Verification of identity in entries
In the event of a structural profile dispute regarding online tracking data, the entry will be contractually assigned to the natural person registered to the email address submitted at the baseline creation time of the KicksOnFire account profile.
Sponsor reserves the absolute right to mandate that a potential winner display definitive electronic or government proof that they are the primary account holder associated with the win. Third-party automated entry syndicates, script scrapers, or generalized sweepstakes proxy services are strictly barred.
4. Prize parameters & tax responsibility
Prizes consist exclusively of one pair of the designated marketplace sneaker styled to the winner’s size (subject to manufacturer market availability). No substitutions, cash liquidations, or transfers are permitted, except at Sponsor’s sole corporate discretion, where an item of comparable valuation may be substituted.
Winners bear complete and exclusive liability for any local, state, or federal income tax obligations and subsequent localized fees resulting from prize acceptance. Unclaimed sneaker rewards will be permanently forfeited.
5. Selection and regulatory drawing mechanics
Winners are calculated via an automated random drawing process initiated on the published ending date framework of the targeted giveaway. Eligible entries constitute profiles that have accurately satisfied registration rules and remain clean of fraud flags.
Sponsor reserves the absolute right to disqualify any profile or winner, and may permanently refuse to route rewards to any individual who violates these terms, gains asymmetric advantage via application exploits, or engages in fraudulent activity.
6. Winner notification procedures
Potential winners will be contacted via the email address, registered Twitter profile, or Facebook profile linked to their account data within roughly five (5) business days following automated selection. Notification is legally deemed completed at the precise timestamp the notification data is transmitted by our servers.
To successfully claim a reward, the selected individual must respond within ten (10) calendar days of notification transmission. Winners may be required to sign and return an Affidavit of Eligibility, a Liability Release, and a Publicity Release where legally permissible. Failure to reply within this structural timeline, or the return of notifications as undeliverable, will result in immediate reward forfeiture and the automated drawing of an alternate winner.
7. Universal promotional liability releases
By executing an entry within the system, participants contractually agree to release, defend, indemnify, and hold completely harmless Sponsor, its corporate affiliates, logistical fulfillment agencies, and tech vendors (“Released Parties”) from any injury, death, property damage, financial loss, or lawsuit resulting directly or indirectly from participation in the promotion or the receipt, shipment, tracking, use, or misuse of an awarded sneaker prize.
Acceptance of a promotional prize constitutes a permanent, royalty-free grant of permission (except where prohibited by state law) for Sponsor to feature the winner’s username, name, profile image, and general statements for marketing, promotional, and discovery index purposes without further notice or financial compensation.
8. System failure limitations & right to cancel
The Released Parties assume zero operational responsibility for typographical errors, hardware server delays, software chat failures, interrupted network carrier connections, dropped mobile Wi-Fi sessions, or corrupted algorithmic processing queues that limit or impede a user’s capacity to enter a promotional loop.
Sponsor maintains the absolute discretion to cancel, pause, expand, or adjust any active giveaway loop if unauthorized human intervention, network virus distribution, systemic app store errors, or security breaches compromise the fundamental fairness or execution structure of the sweepstakes. ANY ATTEMPT BY AN ENTRANT TO DEVIATELY INFLUENCE, ALTER, OR UNDERMINE THE SYSTEM LOGIC WILL RESULT IN AN IMMEDIATE PLATFORM BAN AND IS SUBJECT TO CIVIL AND CRIMINAL PROSECUTION.
9. Unified dispute & governing law routing
ALL PROVISIONS RELATING TO DISPUTES, CONTRACTUAL INTERPRETATION, JURISDICTION, MANDATORY BINDING ARBITRATION, AND THE CLASS ACTION WAIVER SPECIFIED WITHIN THE MAIN BODY OF THE KICKSONFIRE TERMS OF USE APPLY HOLISTICALLY AND ENTIRELY TO THE RUNNING AND FULFILLMENT OF ALL #FREEKICKS PROMOTIONS.
Any giveaway dispute that escapes arbitration limits shall be adjudicated exclusively within the state or federal courts of Middlesex County, New Jersey, under the substantive laws of the State of New Jersey. Financial recovery for any promotional dispute is contractually capped at a maximum of two hundred fifty dollars ($250.00 USD) in actual out-of-pocket costs, and all rights to claim punitive, exemplary, incidental, or consequential damages are explicitly waived.
10. Promotional identification & brand status
Sneaker brand products designated as prizes within app giveaways are utilized solely for item identification and descriptive inventory context. All intellectual property rights, logos, and trademarks remain the exclusive property of their original manufacturers (e.g., Nike, Jordan, Adidas). The deployment of these promotional items does not represent, imply, or establish an official brand partnership, corporate sponsorship, or commercial endorsement of the promotion by those brand owners.
